The owner of 1800TreeExpert, ISA Certified Arborist Mark Russell grew up right here in Roswell, in Martins Landing to be more precise. He has thrived with his tree service career and has even done work on several city properties, like pruning the trees at Bullock Hall.

Purpose and Intent: The tree protection regulations aim to:
- Establish standards for tree preservation during land development processes.
- Safeguard trees during construction and land development projects to enhance the quality of life in Roswell.
- Protect specimen trees while allowing for reasonable land use.
- Promote a healthy urban forest.
Applicability- These tree protection requirements apply to any activity that requires review under Article 13, with the following exceptions as specified in Sec. 12.1.1.C:
- Removal of trees (excluding specimen trees) from any lot smaller than one acre for constructing detached or attached houses.
- Removal of trees from horticultural properties, such as farms, nurseries, orchards, or tree harvesting.
- Removal of trees by utility companies within dedicated utility easements, necessary to install, remove, repair, or maintain utilities within the easement.
- Removal of trees on public rights-of-way by or on behalf of any federal, state, county, municipal, or other government agency with jurisdiction, necessary to lawfully construct, maintain, repair, or improve public rights-of-way.
- Removal of trees (excluding specimen trees) from detention ponds and drainage easements, necessary for the construction, maintenance, or operation of detention ponds or drainage improvements within drainage easements.
- Removal of any tree that poses a danger to human life or property, as determined by the City Arborist.
- Removal of trees less than 3 inches DBH where no Land Disturbance Permit is required.
Exemptions- The tree protection requirements that protect specimen trees apply to all properties, while the following activities are exempted from the remaining tree protection provisions:
- Removal of trees other than specimen trees from any lot less than one acre in size.
- Removal of trees from horticultural properties, such as farms, nurseries, orchards, or tree harvesting.
- Removal of trees by utility companies within dedicated utility easements, necessary to install, remove, repair, or maintain utilities within the easement.
- Removal of trees on public rights-of-way by or on behalf of any federal, state, county, municipal, or other government agency with jurisdiction, necessary to lawfully construct, maintain, repair, or improve public rights-of-way.
- Removal of trees (excluding specimen trees) from detention ponds and drainage easements, necessary for the construction, maintenance, or operation of detention ponds or drainage improvements within drainage easements.
- Removal of any tree that poses a danger to human life or property, as determined by the City Arborist.
- Removal of trees less than 3 inches DBH where no Land Disturbance Permit is required. However, a tree removal permit application is required to demonstrate that the exemption applies.

12.1.2. – Tree Protection Survey and Plan
Tree Survey Required- A tree survey must be submitted to the City Arborist as part of any application that requires review under Article 13. The survey must:
- Be in the form of a map drawn to scale or a site plan prepared and sealed by a registered land surveyor, registered professional engineer, registered landscape architect, an arborist certified by the International Society of Arboriculture, or a registered forester.
- Include important natural features, such as streams, stream buffers, and wetlands.
- Label all specimen trees and their critical root zones and drip lines, even if the tree trunk is not on the subject property, and inventory them by size and species.
- Inventory all other trees
Tree Removal:
- The regulations apply to anyone removing trees, including tree removal companies, utility companies or persons in the business of removing trees or construction.
- A permit is required before any tree removal or work can be undertaken, and the permit must be displayed on the site.
- Emergency tree removal by utility companies is allowed without a permit, but must be reported to the City Arborist within 3 days of completion.
- No specimen tree can be removed without justification and approval from the Engineering Director, based on a written analysis that considers alternative site and building designs and the cost of modifications, among other factors.
- A contribution to the Roswell Tree Bank is required for the removal of any specimen tree, based on the tree density units of the specimen tree removed.
- The minimum required tree density must be maintained on all sites subject to the tree protection requirements.
Variances and Appeals:
- Applicants with a hardship imposed by the standards for tree protection may seek a variance to the standards.
- Applicants dissatisfied with a staff decision regarding tree protection may appeal the decision to the Board of Zoning Appeals.
Minimum Tree Density:
- All sites subject to the tree protection requirements must maintain a minimum tree density, measured in units per acre.
- The required tree density units vary based on the location of the site.
- The minimum required tree density may be achieved by protecting existing trees and by planting new trees on the site.
